Balls To The Wall: Marilyn Manson Sued Again For Crotch-Related Assault

A security guard has sued Marilyn Manson, claiming that the shock rocker assaulted him at an October 27th, 2000, concert in Minneapolis, making it the second time in four months Manson has been sued over rubbing his crotch over the head of a security guard!
David M. Diaz of Anoka County, Minnesota, filed a $75,000 civil suit against Manson on Tuesday in a Minneapolis federal court. Diaz is a security guard who was working the front barricade at Minneapolis' Orpheum Theatre during the kick off date of Manson's Guns, God and Government tour. Diaz claims the frontman grabbed his head, held his hips against it and gyrated and is seeking more than $75,000 for emotional distress and other injuries. The suit also names Manson's touring company, Jimmy's Touring Inc.; local security firm ABCXYZ Corp., of which Diaz was an employee; and Vivendi Universal, the corporate owners of Universal Music Group, Interscope Records and Nothing Records.
According to a court spokesperson, Diaz is claiming battery and emotional distress, ridicule and shame, mental anguish, embarrassment, and humiliation as a result of being used as Manson’s underwear. His lawyer, James Kaster, claims to be suing because he’s been the subject of ridicule and is considered "a joke" by everyone who knows of the incident.
"What compels me to get involved is [Diaz's] sense of shame," Kaster stated. "And this just ain't right. You just don't treat people that way, I don’t care who you are. And frankly, a group of jurors in this state are going to be offended." Kaster plans to use the Michigan security guard's deposition to demonstrate a pattern of conduct in his case.
Interscope and Manson's management company had no comment at press time regarding this incident.
In related news, Manson's hearing on felony charges of fourth-degree criminal sexual conduct and misdemeanor assault-and-battery for the first crotch-related incident, which was scheduled first for November 9th and then for December 7th, has now been moved again to December 28th at the request of Manson’s attorney Walter Piszczatowski, who is involved in another trial. The hearing will still take place before Judge Gerald E. McNally of the 52nd District Court in Clarkston, Michigan. Manson is free on $25,000 personal bail after a September 21st arraignment at the court. Piszczatowski has indicated that they'll plead innocent. The case stems from, a July Ozzfest stop in Clarkston, Michigan when a security guard alleges Manson spat on him and, while clad only in a G-string, rubbed his genital area on the his head and neck. The singer pleaded not guilty to the charges in September.
