Buckcherry To Defend "Baseless" Lawsuit By Newsferatu, Writer Thursday, September 14, 2006 @ 2:50 PM
In response to a lawsuit filed September 7th in Los Angeles County Superior Court alleging that rock band Buckcherry and its labels, Warner Music Group and Atlantic Records, willingly allowed a 16-year-old girl into a music video shoot, Buckcherry’s attorney, Skip Miller of the Century City-based firm Miller Barondess, LLP, has issued the following statement:
“The attorneys for the plaintiff (identified only as Jane Doe) have been talking to the press about this case. We feel it is necessary to set the record straight. The claims in this case are entirely unfounded and without merit. Strict precautions were taken to ensure that only those over the age of 18 would gain access to the music video shoot. The casting ad called for over-18 talent only, signs were posted to that effect at the venue, and IDs were checked at the door. This woman not only used a phony ID to gain access, but filled out and signed a talent release form with what we now know to be false birth date information to match her phony ID. She was later seen boasting into the camera about her exploits in the video.”
This lawsuit was filed almost a year after the video was shot, only after the financial success of the band. We are going to defend this action vigorously and let the evidence speak for itself.”
As previously reported, The suit, filed Thursday, September 7, alleges that Buckcherry asked fans to show up at Hollywood's Key Club in October. The plaintiff, a minor identified as Jane Doe who was living in Southern California, was allegedly given alcohol to drink and filmed exposing her breasts, kissing another female and writhing against a pole while Buckcherry performed the song Crazy Bitch.
According to the lawsuit, the music video was posted on the band's website and distributed widely online, as was a "behind the scenes" program that referred to the girl's first name, featured more nudity and had band members saying, "It's like watching seven hours of porn."
Doe's attorney said, "As a result of the video's airing, the minor suffered severe emotional distress, (and) is seeking unspecified damages."
"You can imagine the panic this girl felt when this video started getting aired," he said. "She's been called a lesbian at school. She's had to switch schools because of that video."
The lawsuit alleges that the minor was not asked for identification.
Buckcherry denies all charges, and as stated above, will vigoorously fight the claims made by Jane Doe.
